Terms & Conditions

Last updated: April 1, 2025

1. General

These Terms and Conditions govern all orders placed through maisonmay.fr ("the Website"). By placing an order, you agree to these terms. MAY reserves the right to modify these terms at any time; changes apply to orders placed after the modification date.

MAY is operated as a micro-enterprise (auto-entrepreneur) under French law, acting as an intermediary connecting customers with partner tailoring ateliers in Vietnam. Garments are handcrafted to your specifications by skilled artisans. Full legal information is available on our Legal Notices page.

2. Orders & Contract Formation

An order constitutes an offer to purchase. The contract is formed when you receive our order confirmation email. We reserve the right to refuse orders if payment cannot be verified or if the provided measurements appear inconsistent.

Our team reviews all measurements before production begins. We may contact you for clarification if any measurements seem unusual.

3. Pricing & Payment

All prices are displayed in Euros (EUR), inclusive of all taxes, and include French VAT at the applicable rate (20% standard rate). Our intra-EU VAT number is FR 41 929 030 831 and VAT is shown separately on every invoice.

We accept major credit cards (Visa, Mastercard, American Express) and PayPal. A 50/50 payment option is available: 50% at order and 50% before shipping.

Import duties and taxes may apply depending on your country of residence and are the responsibility of the customer.

4. Made-to-Measure Products

All garments are made-to-measure, crafted specifically to your measurements and customization choices. As such, the standard 14-day withdrawal right for distance selling does not apply to made-to-measure items, in accordance with Article L221-28 of the French Consumer Code and EU Directive 2011/83/EU, Article 16(c).

Before your request is sent, you are asked to tick a dedicated box — separate from your acceptance of these terms — by which you acknowledge having been informed of this exclusion and expressly waive your right of withdrawal for made-to-measure products. Your request cannot be sent without it. The date of that acknowledgment and the revision of these terms in force at that moment are recorded with your order.

However, MAY works with customers on a case-by-case basis to address fit issues (see section 7).

5. Production & Delivery

Production takes approximately 3-4 weeks. International shipping typically takes 1-2 weeks. Total delivery time is 4-6 weeks from order confirmation.

All shipments are fully insured and tracked. Risk of loss transfers to the customer upon delivery. Shipping costs are calculated at checkout based on destination.

If delivery does not occur by the agreed date, you may request delivery within a reasonable additional period by sending a formal notice (mise en demeure) to our contact email. If delivery still does not occur within this additional period, you may cancel your order for a full refund, provided production has not been completed, in accordance with Article L216-2 of the French Consumer Code.

6. Order Modifications

You may modify or cancel your order within 24 hours of placement at no charge. After this period, production may have begun and modifications may not be possible.

Contact us immediately at contact@maisonmay.fr if you need to make changes.

7. Fit Guarantee & Alterations

We work with you to address fit issues. If alterations are needed:

  • You may have alterations done locally by a tailor of your choice. Contact us beforehand to discuss options.
  • Alternatively, you may return the garment to us for alterations (shipping costs apply).

If the garment cannot be altered to your satisfaction, please contact us to discuss a resolution.

8. Customer Responsibilities

You are responsible for providing accurate measurements. While we review measurements for obvious inconsistencies, we cannot guarantee fit if measurements provided are incorrect.

We recommend following our measurement guide carefully or having a professional tailor take your measurements.

9. Legal Guarantees

All products benefit from the legal guarantee of conformity (Articles L217-3 to L217-20 of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code).

Under the legal guarantee of conformity, you have two years from the date of delivery to report a defect of conformity. In such a case, you may choose between repair or replacement of the product. If neither is possible or cannot be carried out within a reasonable time, you may obtain a price reduction or a full refund.

Under the guarantee against hidden defects, if you can prove that the product has a hidden defect that existed at the time of sale and renders it unfit for its intended use, you may choose between rescinding the sale or obtaining a price reduction, within two years of discovering the defect.

10. Intellectual Property

All content on this website, including images, text, and designs, is the property of MAY and protected by intellectual property laws. You may not reproduce or redistribute any content without written permission.

11. Limitation of Liability

MAY's liability is limited to the purchase price of the ordered items. We are not liable for indirect, incidental, or consequential damages.

This limitation does not apply to damages caused by gross negligence or wilful misconduct on our part, nor to personal injury. This clause does not affect your statutory rights as a consumer, including the legal guarantees described in section 9.

12. Privacy

Your personal data is processed in accordance with our Privacy Policy, in compliance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (Loi Informatique et Libertés).

The data controller is MAY. Data is processed on the legal basis of contract performance (Art. 6(1)(b) GDPR) for order fulfillment, and legitimate interest (Art. 6(1)(f) GDPR) for service improvement. You have the right of access, rectification, erasure, portability, restriction, and objection. You may also lodge a complaint with the CNIL (Commission Nationale de l'Informatique et des Libertés), the French data protection authority, at www.cnil.fr.

13. Consumer Mediation

In accordance with Articles L612-1 et seq. of the French Consumer Code, you have the right to resort to a consumer mediator free of charge in the event of a dispute. Our designated consumer mediator is:

[NOM_DU_MÉDIATEUR] — [SITE_WEB_DU_MÉDIATEUR] — [ADRESSE_DU_MÉDIATEUR]. You may submit your request online or by post. Mediation must be sought within one year of your initial written complaint to us.

14. Disputes & Governing Law

We encourage you to contact us first with any concerns at contact@maisonmay.fr. We aim to resolve complaints within 14 days.

These terms are governed by French law. For EU consumers, mandatory consumer protection laws of your country of residence apply where they offer greater protection.
